Replacement of Green Cards without Expiration

The USCIS has proposed a rule to terminate the validity of Permanent Resident ("green") Cards (Form I-551) that do not have an expiration date. Between 1979 and 1989, permanent resident cards were issued without expiration dates; since then they have been issued in 10 year increments.

The USCIS has also proposed a time period of 120 days to allow anyone who still has a permanent resident card without an expiration date to apply for a replacement. The USCIS expects that approximately 750,000 lawful permanent residents may need to apply for a replacement. Please note that this process includes biometrics (photographs and fingerprints) and background (security and criminal history) checks. Anyone with a criminal/arrest history should contact an attorney before applying.

The public may comment on the proposed rule until September 21, 2007. The rule will become effective at some point after the comments are reviewed by DHS.

Although it is not required, you may apply for your replacement card now. E-filing of the required form, Form I-90, is encouraged. Form I-90 can be found by going to www.uscis.gov and clicking the Immigration Forms tab.
