The Immigration Service announced that starting June 29, 2009 it will resume premium processing for I-140 Immigrant Petition for an Alien Worker. Premium processing of I-140 petitions was suspended in 2007 and then brought back under limited circumstances in the summer of 2008.
Under premium processing, the Service guarantees that petitioners may pay an additional $1000 processing fee and receive an approval notice, a notice of intent to deny, or a request for evidence within 15 days of filing.
As of June 29, 2009, premium processing will be available for I-140 petitions involving:
- EB-1 Aliens with Extraordinary Ability;
- EB-1 Outstanding Professors and Researchers;
- EB-2, Members of Professions with Advanced Degrees or Exceptional Ability not seeking a National Interest Waiver;
- EB-3 Professionals;
- EB-3 Skilled Workers; and
- EB-3 Workers other than Skilled Workers and Professionals.
Please note that the premium processing service will NOT be available for I-140 petitions involving:
- EB-1 Multinational Managers/Executives; and
- EB-2 Members of Professions with Advanced Degrees or Exceptional Ability seeking a National Interest Waiver.
