Lawsuit is Filed Seeking Public Release of USCIS Records Concerning its Policies and Procedures for the H-1B Visa Program

The American Immigration Council’s Legal Action Center filed a lawsuit in the federal district court in Washington D.C. asking the court to compel the USCIS to release records of its policies and procedures concerning the H-1B program. The Legal Action Center had sought these documents under the Freedom of Information Act. The USCIS declined to release any of the requested documents. The Legal Action Center argues that the USCIS has obligation to release these “secret rules and guidelines” at a time when the USCIS has implemented new, more stringent procedures for the review of H-1B petitions and is pursuing an active program of worksite inspections (estimated to reach 25,000 in 2010).
