Suit Challenging Third Party Placement Memo is Dismissed

The District Court of the District of Columbia dismissed Broadgate, Inc., et al v. USCIS, the suit challenging the January 8, 2010 Neufeld employer-employee/third-party placement memo. The court found that the memo did constitute final agency action and therefore was not subject to judicial review or the notice and comment requirements for the promulgation of regulations. The court found that the memo established guidelines only and was not binding on USCIS adjudicators.
