The Immigration Service announced at 8:01 p.m. EST on January 27 that it had received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year 2011 (October 2010 through September 2011). The Service further announced that the previous date of January 26, 2011 would serve as the final receipt date for new H-1B specialty occupation petitions under the fiscal year 2011 cap.
Please note that the fiscal year 2012 cap opens for filing (only) on April 1, 2011. Beneficiaries with H-1B petitions approved under the fiscal year 2012 cap will be able to commence employment in H-1B status no earlier than October 1, 2011.
