USCIS Reinstates 84-day Response Time for Requests for Evidence

USCIS has issued a Policy Memorandum that reinstates an 84-day response time for Requests for Evidence (RFEs). It states that, for all filings, except those applications filed on Form I-539, USCIS will allow the petitioner/applicant a period of 84 days to submit additional evidence in response to an RFE. Form I-539 applicants will be required to submit additional evidence within 30 days.

If the RFE has been sent by mail, the petitioner/applicant will have an additional 3 days to respond, if the petitioner/applicant is in the U.S. or an additional 14 days to respond for filings from outside the United States.

The USCIS has requested comments from the public to be sent by July 27, 2011, but the Policy Memorandum is effective on an interim basis as of July 13, 2011.
