The USCIS has announced that they intend to publish a rule in the Federal Register that will require all petitioners filing H-1B cap subject petitions to electronically register prior to submitting the actual petition. The plan appears to require registration with information about the petitioner and beneficiary. Then, only if an H-1B Cap number is allocated, based on the registration, will the company be required to submit the petition, the fees and the supporting documents. There will be safeguards built into the system to ensure that the petitioner cannot register for the same beneficiary more than once. It is expected the rule will be announced in January 2011.
