The central DOL Division of Foreign Labor Certification issued a new memorandum on November 20, 2003 on how RIR labor certification applications in all fields, including IT, will be reviewed. An initial review of the recruitment pattern, completeness, and compliance with all requirements will be conducted. If found deficient, the DOL may issue a request for more information or clarification called a Notice of Findings. If the application passes this initial screening, the DOL stated it would certify cases where the job requires a Bachelor’s Degree and 3 years of experience or a Master’s Degree and 6 months of experience. If the job does not meet these requirements, the DOL will then consider whether the recruitment and the reporting of recruitment results were sufficient. If these are favorably reviewed, the DOL stated it would certify the case. In the remaining cases, the DOL stated it would allow the employer to withdraw the case; have the case remanded to the state agency for supervised recruitment; or retest the labor market under designated procedures.
